Welcome to Nayburlee. By accessing and using our website and services (“Platform”), you agree to be bound by these Terms & Conditions (“Terms”) in full. If you do not agree with these Terms, please do not use our Platform.

1. Acceptance of Terms

By using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy, Cookie Policy, Refund & Cancellation Policy, Acceptable Use Policy, and any other policies referenced herein. These Terms govern your access to and use of all content, features, and services provided by Nayburlee.

2. Modifications to the Terms

Nayburlee reserves the right to modify these Terms at any time. Any changes will be effective upon posting the revised version on our website with a new "Effective Date" indicated. It is your responsibility to review these Terms periodically. Your continued use of the Platform following the posting of changes constitutes your acceptance of such changes.

Notification of Changes: For material changes to these Terms, Nayburlee will notify users by email (if you have provided one), by displaying a prominent notice on the Platform, or via a banner on the website.

3. Use of the Platform

Eligibility: You must be of legal age in your jurisdiction to enter into binding agreements.
Account Registration: Where applicable, you agree to provide accurate, current, and complete information during registration and update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials.
Acceptable Use: You agree to use the Platform only for lawful purposes and in a manner that does not infringe or restrict the rights of others, as further defined in our Acceptable Use Policy.

4. Services and Booking Process

Service Description: Nayburlee provides a marketplace that connects verified, on‑demand spaces with creators, professionals, and tenants seeking flexible, short-term rentals.
Booking Procedure: All bookings are subject to host approval, and the Platform facilitates the communication, payment, and administrative processes associated with such bookings. For details, please refer to our Refund & Cancellation Policy and the guidelines provided during the booking process.
Cancellation Procedures: All booking cancellations, refunds, and dispute resolutions shall be governed by Nayburlee’s Refund & Cancellation Policy and, where applicable, the Host Terms of Service.

5. Payments and Refunds

Payment Terms: Payment for bookings is captured at the time of booking via our secure payment system. However, funds are held by Nayburlee until the tenant’s first session has commenced. After confirmation that the session has begun, 85% of the booking amount is released to the host within 1–5 working days, and the remaining 15% is retained by Nayburlee as a service fee.
Refunds: Refunds are governed by our Refund & Cancellation Policy. By agreeing to these Terms, you acknowledge and accept the payment procedures and cancellation rules outlined therein.

Cancellation Outcomes (Summary):
• If a user cancels more than 24 hours before the session, they receive a full refund.
• If the user cancels less than 24 hours before, they may receive no or a partial refund as per our Refund & Cancellation Policy.
• If a host cancels a confirmed booking or is a no-show, the user is entitled to a full refund.

6. User Content

If you post, upload, or otherwise submit any content to the Platform (including reviews, comments, images, or other materials), you retain ownership of your content but grant Nayburlee a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute such content in connection with the operation and promotion of the Platform. You are solely responsible for any content you submit and must ensure it does not violate any laws or third-party rights. Nayburlee reserves the right to remove or disable access to any user content at its sole discretion, including in response to complaints or suspected violations of these Terms or applicable law.

7. Intellectual Property

All content, trademarks, logos, and other intellectual property on the Platform are the property of Nayburlee or its licensors. You are granted a limited, non-exclusive, non-transferable license to access and use the Platform solely for your personal use. Any unauthorised use of our intellectual property is strictly prohibited.

8. Disclaimers and Limitation of Liability

No Warranty: The Platform and all information, products, and services provided therein are offered "as is" and "as available" without any warranties, express or implied.
Limitation of Liability: In no event shall Nayburlee be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Platform.
Indemnification: You agree to indemnify, defend, and hold harmless Nayburlee and its affiliates from any claims, liabilities, losses, and expenses arising from your use of the Platform or breach of these Terms.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising in connection with these Terms will be subject to the exclusive jurisdiction of the courts in Johannesburg, South Africa.

10. Termination

Nayburlee reserves the right to suspend or terminate your access to the Platform at its sole discretion, without notice, for conduct that violates these Terms or is otherwise harmful to the business or other users.
